Question : nohup tcpdump -C 1 tries to creat the next file in succession and gets permission denied...

I am running tcpdump. Im using the command nohup tcpdump -C 1 to log packets and then create a new file when the first file fills up. pdump reaches the 1,000,000 byte point and tries to create another file it gives the following error:
tcpdump: tcpdump.log1: Permission denied
Im running as root... so I assume the process would have the same permissions?
What might be causing it?
