Question : I can ping across subnets to my 2003 Domain server but can not reach my 2008 Server
In the same subnet I can ping my 2008 server fine. I can ping the alernate subnet from the 2008 server.
IE: 10.0.1.207 can ping 10.0.0.3(2003 Domain Server) and can not reach 10.0.0.95(2008 Server), 10.0.0.95 can ping 10.0.1.207, 10.0.0.3 can reach 10.0.0.95
Other clients in the 10.0.0 subnet can reach the 2008 server as well.
Firewall on or off does not make a difference.

Verify the route info on the 2008 - maybe you need to create a static route for the 10.0.1.x subnet (check with the 2003 server using a cmd box and type "route print" - static routes are displayed apart).
